N.J. Appellate Court Reverses Summary Judgment Award for Ship Defendants in Asbestos Case

TRENTON, N.J. –– A New Jersey appellate court has reversed an awarded of summary judgment to two defendants, finding there was in fact enough evidence to establish that the plaintiff could have been exposed to asbestos while working aboard the defendants’ vessels.

In the March 3 opinion, the New Jersey Superior Court, Appellate Division, wrote that the plaintiff’s testimony, combined with other evidence and expert testimony, was enough for a factfinder to reasonably conclude that the plaintiff was exposed to asbestos while employed by the defendants.
