W.Va. Senators Propose Asbestos Bankruptcy Trust Claim Legislation, Creation of Inactive Docket

CHARLESTON, W.Va. –– Senators in West Virginia has proposed legislation that would require asbestos claimants to reveal the asbestos bankruptcy trusts with which they have filed claims.

The same legislation –– introduced Feb. 4 in the West Virginia Senate –– proposed creating an inactive docket for both asbestos and silica claims, only allowing those plaintiffs that can demonstrate a physical impairment to proceed with their lawsuits.

Senator Tom Takubo (R) is the lead sponsor on the bill, while Senators Mitch Carmichael (R), Ryan Ferns (R), Ed Gaunch (R), and Jeff Mullins (R) co-sponsored the legislation.
