RALEIGH, N.C. - A state appeals court has upheld a decision to deny a claim for death benefits to the wife of a former millwright who died of alleged asbestos-related lung cancer years after he was diagnosed with asbestosis. Hatcher v. Daniel International Corp., et al., No. 01-1342 (N.C. App.).

Marion I. Hatcher, as the executor of the estate of her late husband, Norman, was denied her claim for benefits after it was determined that Norman Hatcher's last injurious exposure to asbestos likely occurred while working for a company other than the one from which he sought benefits.
