Health Insurers Seek Claimant Details from H.K. Porter Asbestos Trust for Declaratory Action

PHILADELPHIA –– A number of health insurers have filed a pre-complaint interrogatory asking the H.K. Porter Asbestos Trust to identify individuals who have made a claim against the defendant, saying the information is necessary in order to determine subrogation and reimbursement rights.

In the Jan. 28 pre-complaint interrogatory, 40 insurers –– including Blue Cross and Blue Shield, Aetna and Humana –– said they intend to sue the H.K. Porter Asbestos Trust, seeking recovery from the trust “in subrogation of expenses of treating the adverse health outcomes their members experienced from exposure to asbestos-containing products.”
