LOS ANGELES –– A California appellate court has reversed an award of summary judgment for Warren Pumps, concluding that the plaintiff’s testimony that he removed “dry and brittle” material from the defendant’s products created a triable of fact.

In the Jan. 31 opinion, the California 2nd District Court of Appeal concluded that the defendant had not satisfied its burden as the party moving for summary judgment “and therefore is not entitled to summary judgment.”
