Wash. Court Refuses to Reconsider Decision Allowing Take-Home Asbestos Exposure Claims to Proceed

TACOMA, Wash. –– A Washington federal court has maintained its position that asbestos plaintiffs will be permitted to bring take-home asbestos exposure claims to trial, opining that the plaintiffs have presented enough evidence to support a finding that the dangers of take-home exposure were known, or should have been known, to the defendants as early as the 1950s.

In its Dec. 30 order denying Owens-Illinois and Crown Cork & Seal Co. Inc.’s motion for reconsideration, the U.S. District Court for the Western District of Washington said that the case was distinguishable from a recent decision that reached the opposite conclusion, …
