R.I. Court Allows Majority of Asbestos Claims to Proceed Against Transportation Defendants

PROVIDENCE, R.I. –– A Rhode Island court has denied a motion to dismiss a number of asbestos claims, finding that the plaintiffs had adequately pleaded claims against defendants who provided water-based transportation services with boats that allegedly contained asbestos-containing material.

In its Feb. 22 decision, the Rhode Island Superior Court did, however, dismiss the plaintiffs’ claims for breach of express warranties and breach of the implied warranty of fitness for a particular purpose, ruling that the plaintiffs had failed to establish that they would be entitled to relief under those causes of action.
