N.Y. Court Awards Summary Judgment to General Contractor in Asbestos Suit

NEW YORK –– A New York state court has awarded summary judgment to asbestos defendant Tishman Liquidating Corporation Inc., ruling that the plaintiffs had failed to prove that the general contractor had control over work completed at a construction site.

In the Feb. 13 order, the New York Supreme Court for New York County found that the defendant could not be held liable under Labor Law § 200.

The plaintiffs contend in the underlying claims that Jeffrey A. Zayas’ asbestosis was caused by asbestos exposure incurred while working for the Otis Elevator Company. While employed, Zayas says he …
