N.Y. Federal Court Remands Asbestos Action, Notes Activity Already Taking Place in State Court

SYRACUSE, N.Y. –– A New York federal court has remanded an asbestos action, noting that the defendant who removed the complaint has since been dismissed from the case.

In the Jan. 23 opinion, the U.S. District Court for the Northern District of New York additionally found that since the most recent claims asserted by the plaintiffs are grounded in state law and the parties had taken some depositions in state court, remand was proper.
