MDL Court: Plaintiffs Have Yet to Provide Evidence Connecting Illness to Defendants’ Products

PHILADELPHIA –– The court overseeing the national asbestos products liability MDL has denied efforts by plaintiffs to obtain a ruling regarding specific facts of their case against several defendants, including Todd Shipyards.

In the Oct. 18 opinion, the U.S. District Court for the Eastern District of Pennsylvania wrote that while the plaintiffs had established that the decedent suffered from mesothelioma, they had not proven which defendants’ products caused the injury.

The plaintiffs filed the claims on behalf of Freddie Joseph Dupre, who allegedly developed mesothelioma as a result of exposure to asbestos-containing products while working at Todd Shipyards.
