Pa. Supreme Court to Review Appeal Involving Frequency, Regularity, Proximity Standard

PHILADELPHIA –– The Pennsylvania Supreme Court will review the reversal of summary judgment awards for several asbestos defendants, according to separate Oct. 11 orders granting petitions for allowance of appeal.

In the orders, the high court states that it will address the intermediate appellate court’s order that permitted a plaintiff to defeat summary judgment by submitting generic, non-case-specific expert affidavits instead of evidence of regular, frequent and proximal exposure to the defendants’ individual products.

The Supreme Court will also take a look at whether the appellate court erred by holding that the plaintiff did not have to present evidence …
