N.Y. Court Rejects Efforts to Try 2 Asbestos Cases Together

NEW YORK –– A New York trial court has denied attempts to consolidate two asbestos cases for trial, opining that the grounds for the allegations in each complaint do not overlap enough to justify trying the cases together.

In the Sept. 19 order, the New York Supreme Court for New York County noted that while one case involves mechanic and U.S. Naval exposure, the second case asserts allegations of take-home exposure.

The plaintiffs in both actions moved to consolidate the cases for trail, arguing that the injured parties were exposed to similar products. The defendants opposed the consolidation.
