Del. Court Says Question Exists as to Whether Gaskets Were Dangerous

WILMINGTON, Del. -- Efforts by a gasket manufacturer to convince a Delaware court that it had no duty to warn an asbestos plaintiff have been denied, as the court opined that a question existed as to whether the defendant knew or should have known the potential dangers associated with its product. Wilkerson, et al. v. American Honda Motor Co., Inc., et al., No. 04C-08-268 ASB (Del. Super. Ct., New Castle Cty.).
In the Jan. 17 order, Judge Mary Johnston of the Superior Court for New Castle County concluded that the asbestos claims asserted against McCord Corp. could continue.
