New York Appeals Court Upholds Determination of Insurance Coverage in Asbestos Case

ALBANY, N.Y. -- A New York appellate court has upheld a finding that Zurich American Insurance Co. is responsible for covering an underlying asbestos claim. Longo v. Graphic Packaging Corp., et al., No. 511865 (N.Y. Sup. Ct., App. Div., 3rd Jud. Dept.).

In the Nov. 23 ruling, the New York Supreme Court, Appellate Division, 3rd Judicial Department, said that the insurance company, as well as the claimant's employer, had several opportunities to present evidence that the employer's parent company was instead responsible for covering the claim but failed to do so.
