Nevada Court Addresses Dispute over Substitution of Deceased Plaintiff

RENO, Nev. -- A Nevada court has dismissed a plaintiff from a case involving asbestos defendants, ruling that no proper substitutions were made on his behalf after his death. Butler, et al. v. Pneumo Abex LLC, et al., No. CV11-01202 (Nev. 2nd Jud. Dist. Ct., Washoe Cty.).

In the Nov. 21 order from the Nevada 2nd Judicial District Court for Washoe County addressed plaintiff counsel conflicts but allowed the recently appointed counsel to proceed with the case.

According to the court's report, Stephen Healy, a lawyer formerly with the California-based plaintiffs' firm Brayton Purcell, filed the lawsuit in Nevada against …
