Ill. Court Declines to Review Decision Throwing Out $2.5 Million Verdict

SPRINGFIELD, Ill. -- An Illinois appellate court has reissued an earlier decision in which it reversed a $2.5 million asbestos verdict, noting in the more recent document that it has been modified upon the denial of the plaintiffs' motion to rehear. Rodarmel, et al. v. Pneumo Abex, et al., No. 4-10-0463 (Ill. 4th Dist. Ct. App.).

On Sept. 15, the Illinois 4th District Court of Appeals denied the plaintiffs' request that the court review its earlier decision on grounds that the majority opinion was based on evidence that was "factually wrong" and "contrary to undisputed testimony received at trial."
