PHILADELPHIA -- The court overseeing the national asbestos MDL has declined to award summary judgment to a shareholder defendant, ruling that there is evidence that a portion of the plaintiffs' claims were governed by Alabama's discovery rule since they accrued after 1979. Archer v. Mead Corp., et al., No. 09-70093; McGuffie v. Mead Corp., et al., No. 09-70095; Riggs v. Mead Corp., et al., No. 09-70094 (E.D. Pa.).
