Texas Court Reverses Monetary Sanctions Entered Against Union Carbide

DALLAS -- A Texas appellate court has reversed sanctions of more than $11,000 entered against counsel for Union Carbide, ruling that the trial court did not show that it had considered, and rejected, lesser sanctions. Union Carbide Corp., et al., v. Martin, No. 05-09-01052-CV (Texas 5th Dist. Ct. App.).
In the July 13 ruling, the Texas 5th District Court of Appeals found that Union Carbide's actions did not significantly interfere with the trial court's "legitimate exercise of its core functions."
