Ill. Plaintiffs Ask Court to Review its Decision Throwing Out $2.5 Million Verdict

SPRINGFIELD, Ill. -- Asbestos plaintiffs have asked an Illinois appellate court to review its decision reversing a $2.5 million verdict, arguing that the majority opinion was grounded in evidence that was "factually wrong" and "contrary to undisputed testimony received at trial." Rodarmel, et al. v. Pneumo Abex, et al., No. 4-10-0463 (Ill. 4th Dist. Ct. App.).
Stating that the majority "misstates the record on repeated occasions," the plaintiffs asked the Illinois 4th District Court of Appeal to vacate its earlier decision and instead affirm the trial court's judgment.
