Calif. Court Affirms Summary Judgment Award, Cites Lack of Product Identification

LOS ANGELES -- A California appellate court has affirmed an award of summary judgment in favor of asbestos defendant Pneumo Abex LLC, finding that the defendant had sufficiently established that plaintiffs could not establish exposure to the company's asbestos-containing brake products. Smalley, et al. v. Pneumo Abex LLC, et al., No. B223233 (Calif. 2nd Dist. Ct. App., Div. 2).

In the March 24 opinion, the California 2nd District Court of Appeal said that the plaintiffs failed to establish that Pneumo Abex had not satisfied its initial burden in moving for summary judgment.
