Court Stays Discovery; Cites Law Firm's Intention to File Appeal with U.S. Supreme Court

WHEELING, W.Va. -- A West Virginia federal court has agreed to stay discovery in a lawsuit filed against an asbestos plaintiff firm that allegedly fabricated asbestos claims while the defendant seeks the appeal of a recent 4th Circuit decision in the U.S. Supreme Court. CSX Transportation Inc., v. Gilkison, et al., No. 05-00202 (N.D. W.Va.).

According to the March 8 order issued by the U.S. District Court for the Northern District of West Virginia, the parties agreed that delaying discovery would be appropriate while the defendants sought an appeal with the U.S. Supreme Court.
