MDL Judge Dismisses Claims Against Engine Manufacturer in Asbestos Case

PHILADELPHIA -- The judge overseeing the federal Asbestos Products Liability Litigation has adopted a report and recommendation in which a magistrate judge suggested the dismissal of claims asserted against an engine manufacturer. Travis, et al. v. 3M Co., et al., No. 09-70104 (E.D. Pa.).

In a Jan. 28 order, the U.S. District Court for the Eastern District of Pennsylvania adopted a September report and recommendation that found while the plaintiff had established he was in the vicinity of the engines, there was insufficient evidence that these engines contained asbestos.
