Federal Court: Deposition of Plaintiff Taken in Separate Asbestos Action Inadmissible

PHILADELPHIA -- The court overseeing the federal Asbestos Multidistrict Litigation has granted a motion for summary judgment, ruling that the plaintiff had presented insufficient evidence to establish that he was exposed to the defendant's product. Cowley, et al. v. ACandS Inc., et al., No. 07-62831 (E.D. Pa.).

In the Dec. 23 ruling, the U.S. District Court for the Eastern District of Pennsylvania reached its conclusion after determining that a deposition of the plaintiff -- taken in a separate asbestos action in which the defendant was not involved -- was inadmissible.
