SPRINGFIELD, Ill. -- A group of defendants have filed a motion with the Illinois Supreme Court to review procedures for asbestos cases in Madison County, contending in part that a decision issued last year by the high court actually denies defendants of proof they require to establish a sole proximate cause defense. In re: All Madison County Asbestos Plaintiffs and Defendants v. Volkswagen Group of America Inc., et al., No. n/a (Ill. Sup. Ct.).
In the Aug. 6 brief, the defendants additionally claim that they are denied rights to setoffs that are guaranteed under the Contribution Act.
