Court Affirms Dismissal of Borg-Warner from Case, Says Product ID Lacking

CLEVELAND -- An Ohio appellate court has affirmed an award of summary judgment to Borg-Warner, ruling that evidence of the defendant's supply of asbestos-containing products to the plaintiffs' worksite prior to their employment isn't sufficient to establish product identification. Cantrell, et al., v. Adience Inc., et al., No. 93944 (Ohio Ct. App., 8th Dist., Cuyahoga Cty.).

In the Aug. 5 ruling, the 8th District Court of Appeals for Cuyahoga County ruled that "there still needs to be some evidence that the product was at the GM plant at or near the time of alleged exposure."
