Court Reverses Judgment, Says Plaintiffs Sufficiently Revised Class Action

GRETNA, La. -- A Louisiana appellate court has reversed the judgment of a trial court that granted an exception of res judicata, ruling instead that the plaintiffs had sufficiently narrowed the focus of their complaint. Bourgeois, et al. v. A.P. Green Industries Inc., et al., No. 09-CA-753 (La. Ct. App., 5th Cir.).

In the March 23 opinion, the Louisiana 5th Circuit Court of Appeal said that the plaintiffs' amended complaint addressed pleading deficiencies the appellate court had outlined in a previous opinion.

The complaint is a proposed class action file by current and former employees of Avondale Industries Inc. …
