FRANKFORT, Ky. -- A Kentucky appellate court has affirmed the dismissal of an asbestos-related FELA action, ruling that the plaintiff's repeated delays in the case left the trial court no choice but to dismiss the case. Crane v. Illinois Central Railroad Co., No. 2008-000890 (Ky. Ct. App.).
In the Jan. 29 opinion, the Kentucky Court of Appeals further affirmed the trial court's decision that certain claims in the lawsuit were precluded by the statute of limitations.
The claims were asserted on behalf of the estate of Bobby Crane, who was allegedly exposed to asbestos while working with Illinois Central Railroad. …
