Borg-Warner Garners Amici Support in Substantial Factor Dispute in Ohio

CLEVELAND -- The Coalition for Litigation Justice Inc. has filed an amici brief in an Ohio appellate court, supporting a trial court's award of summary judgment to Borg-Warner Corp., that found the plaintiff failed to properly establish causation. Cantrell v. Adience Inc., et al., No. 09-093944 (Ohio 8th Dist. Ct. App., Cuyahoga Cty.).

The Dec. 21 brief filed in the Ohio Eighth District Court of Appeals for Cuyahoga County, says that the plaintiff seeks to expand Ohio evidence laws by grounding her claims in evidence of her habitual acts or routine.
