Calif. Court Reverses Judgment, Says Allocation of Liability too High

LOS ANGELES -- A California appellate court has reversed a nearly $4.7 million judgment entered against Kaiser Gypsum Co. Inc., ruling that while the evidence supports a causal finding against the joint compound manufacturer, the assessment of 30 percent liability was too high. Silvestro, et al. v. Kaiser Gypsum Co. Inc., No. B196906 (Calif. 2nd Dist. Ct. App., Div. 8).

In the April 13 ruling, the Second Appellate District Court of Appeal declined to say how much liability should have been apportioned to the defendant, but reversed the judgment and remanded the case for a determination on the matter.
