PHILADELPHIA - A majority of the Pennsylvania Superior Court has affirmed that asbestos plaintiffs lack standing to challenge the constitutionality of Pennsylvania's successor statute, 15 Pa. Civil Statute Annotated § 1929.1 Burger, et ux. v. Owens Illinois Inc., No. E04005/08 (Pa. Super.).

In a Feb. 11 opinion, the court also ruled, unanimously, that the plaintiffs failed to prove that a woman inhaled asbestos fibers while she and her husband worked with a asbestos-containing product during a home repair project.
