Court Says Plaintiffs Lack Standing to Challenge Successor Liability Statute

PHILADELPHIA -- A Pennsylvania appellate court has affirmed the dismissal of Crown, Cork & Seal Co. from three asbestos lawsuits, ruling that the plaintiffs lacked standing to contest a successor liability statute on constitutionality grounds. Johnson v. American Standard, et al., No. 2954 EDA 2006; Mauger v. A.W Chesterton, et al., No. 2955 EDA 2006; Stea v. A.W. Chesterton, et al., No. 2956 EDA 2006 (Pa. Super. Ct.).

In the Feb. 6 decision, the Pennsylvania Superior Court further ruled that because the plaintiffs could recover damages from the remaining defendants, the statute did not adversely affect the plaintiffs.
