CLEVELAND -- An Ohio appellate court has affirmed a summary judgment award for a premises defendant in a household exposure case, rejecting the plaintiff's attempts to challenge a statute prohibiting recovery for individuals who do not allege exposure on the defendant's premises. Adams, et al. v. Goodyear Tire and Rubber Co., et al., No. 91404 (Ohio 8th App. Dist., Cuyahoga Cty.).

In the Feb. 5 opinion, the Eighth District Court of Appeals for Cuyahoga County also upheld the dismissal of the plaintiff's negligence claim, ruling that because the exposure did not occur on the defendant's property, no duty of care …
