Federal Judge Sends Paxil Teen Suicide Case to Trial

PHILADELPHIA - A Pennsylvania federal judge has denied GlaxoSmithKline summary judgment in a Paxil wrongful death lawsuit, ruling that genuine issues of material fact exist as to whether the drug maker negligently and/or intentionally failed to warn of the increased risk of suicide in pediatric patients. Knipe v. GlaxoSmithKline, No. 06-3024 (E.D. Pa.).

On Sept. 30, Senior Judge Ronald L. Buckwalter of the U.S. District Court for the Eastern District of Pennsylvania ruled that these issues "must be resolved by a jury after a full trial on the merits."
