Court: Adequate Warning Finding Also Extinguishes Strict Liability Claims

TAMPA, Fla. - A judge who awarded summary judgment to Hoffman-La Roche after determining that suicide warnings the company placed on its Accutane label were adequate has extended the ruling to a plaintiff's strict liability claims. Stupak v. Hoffman-La Roche, 05-926-T-30TBM (M.D. Fla.).

Judge James S. Moody Jr. of the U.S. District Court for the Middle District of Florida ordered the file in the case of B.J. Stupak closed in a Nov. 29 ruling in which Judge Moody stated that Wisconsin courts have historically viewed negligent failure-to-warn and strict liability claims identically.
