JACKSON, Miss. - Mississippi's Supreme Court has reversed a trial court order denying Wyeth's motion to change venue in a Redux lawsuit, finding that the lower court erred in not transferring the case to the county in which plaintiff ingested the drug. American Home Products Corp., et al. v. Sumlin, No. 2004-IA-02524-SCT (Miss. Sup. Ct.).
In a Nov. 16 opinion, the high court said that plaintiff Myra Sumlin's alleged injury purportedly caused by Wyeth's now-withdrawn diet drug Redux did not occur or accrue in Mississippi's Smith County, where Sumlin lived when she filed suit there in October 2002 against Wyeth …
