NEW YORK - A Fosamax injury lawsuit filed by a United Kingdom citizen has been dismissed in favor of a U.K. forum by a New York federal judge, who found that the litigation has no significant connection to New York. Miller v. Merck & Co., No. 06-5087 (S.D. N.Y.).
Judge John F. Keenan of the U.S. District Court for the Southern District of New York concluded that the plaintiff chose the New York forum "for tactical purposes" and that the U.K. has a strong interest in the litigation.
