NEW ORLEANS - The 5th Circuit U.S. Court of Appeals has affirmed dismissal of a Texas resident's untimely lawsuit against Metabolife, finding that the discovery rule did not apply to extend the statute of limitations. Bridges v. Metabolife International, Inc., et al., No. 04-20110 (5th Cir.).
Jeffrey Bridges sued Metabolife on May 28, 2003, alleging that a stroke he suffered on Sept. 14, 1999, was due to his ingestion of Metabolife 356, a dietary supplement containing ephedra and caffeine.
