Nutraquest Files Complaint Seeking Declaratory/Injunctive Relief from Xenadrine Plaintiffs

TRENTON, N.J. - Nutraquest, Inc., the company that once manufactured Xenadrine RFA-1 and filed for Chapter 11 bankruptcy protection in October 2003, is suing a number of plaintiffs asserting ephedra-related injury claims, seeking a court order that would stay the prosecution of claims against other companies named as defendants in the cases. Nutraquest, Inc., v. Kiley Bechler, et al. No. 03-44147 (RTL) (D. N.J. Bankr.).

The supplement maker's Dec. 2, 2003, complaint requests that the plaintiffs be enjoined from pursuing their claims against companies that allegedly sold or distributed Xenadrine so Nutraquest can begin reorganizing and launching new products.
