IVC Filter Case Survives Summary Judgment Motion in Texas Federal Court

HOUSTON — A federal judge has denied C.R. Bard Inc. summary judgment on a Texas man’s claims that its IVC filter is defective and migrated following implantation, finding a question of fact as to whether they are time-barred.

However, in the April 22 order, Judge Andrew S. Hanen of the U.S. District Court for the Southern District of Texas found that claims based upon the plaintiff’s allegation that the filter caused a 2006 blood clot, or any other blood clotting problem, are time-barred. The judge therefore awarded Bard summary judgment on those claims.
