Ariz. Federal Judge Dismisses Ethicon Pelvic Mesh Case for Failure to State a Claim

PHOENIX — An Arizona federal judge has dismissed a complaint targeting Ethicon’s Gynecare TVT pelvic mesh device, ruling that the plaintiff’s claims for strict liability and negligence were inadequately pled because she failed to connect the device’s alleged defects with her injuries.

In a Nov. 2 order, Judge Diane J. Humetewa of the U.S. District Court for the District of Arizona found the plaintiff relied upon adverse events associated with the device but “simply failed to show how the product caused this Plaintiff’s specific injury.”

However, the judge granted the plaintiff leave to file an amended complaint.
