Calif. DePuy Pinnacle Hip Case Stayed Pending Possible Transfer to MDL Docket

SAN FRANCISCO — A California federal judge has stayed a DePuy Pinnacle hip action pending the Judicial Panel on Multidistrict Litigation’s determination on whether to transfer the case to the MDL docket, ruling that a stay “would advance judicial economy.”

In an Oct. 7 order, Judge Phyllis J. Hamilton of the U.S. District Court for the Northern District of California explained that the MDL court is best situated to decide the plaintiff’s motion to remand the action “in a way that would avoid inconsistent results among like cases.”
