Ill. Judge Orders Briefing in Lupron Case on Timeliness, Liability Issues

CHICAGO — An Illinois federal judge has ordered briefing in a Lupron injury case on the issues of whether the claims against Abbott Laboratories and AbbVie Inc. are timely and the roles of those defendants in the manufacturing and development of the endometriosis drug.

In a March 19 order, Judge Robert M. Dow Jr. of the U.S. District Court for the Northern District of Illinois also ordered the parties to brief the question of whether the second amended complaint as to AbbVie properly relates back under Rule 15(c)(3).
