PHOENIX — An Arizona federal judge has awarded C.R. Bard judgment as a matter of law on plaintiffs’ claim for future damages for cardiac arrhythmia in an IVC filter case, ruling that the mere possibility of future injury is not enough to warrant such an award.
In an Oct. 2 order, Senior Judge David Campbell of the U.S. District Court for the District of Arizona explained that under Wisconsin law, future injuries and medical care must be established by a medical probability, and the plaintiffs failed to do so.
