BENTON, Ill. — A lawsuit accusing AstraZeneca of inadequately warning patients that Seroquel can cause cardiac problems is time-barred because the plaintiff failed to file his lawsuit within two years of being diagnosed with a heart condition, an Illinois federal judge has ruled.
In a Sept. 19 order, Judge J. Phil Gilbert of the U.S. District Court for the Southern District of Illinois said the most recent date the plaintiff knew or should have known of his injury was 2008 when he was diagnosed with Brugada syndrome, yet he waited until 2018 to file suit.
