PHOENIX — An Arizona federal judge has denied plaintiffs’ motion to exclude evidence concerning the Bard IVC filter’s instructions for use from an upcoming bellwether trial, ruling that it is relevant to claims that the device was defectively designed.

In a Sept. 4 order, Senior Judge David Campbell of the U.S. District Court for the District of Arizona also denied plaintiffs’ request to exclude certain guidelines published by the Society of Interventional Radiologists (SIR), finding they are also relevant to plaintiffs’ design defect claim.
