Bard Awarded Summary Judgment on Timeliness Grounds in 3rd Bellwether IVC Filter Case




PHOENIX — An Arizona federal judge has awarded C.R Bard Inc. summary judgment in the third bellwether case on the Bard IVC filter multidistrict litigation docket, ruling that the plaintiff’s claims are barred by Nebraska’s statute of limitations.

In a July 12 docket entry, Judge David G. Campbell of the U.S. District Court for the District of Arizona rejected the plaintiff’s argument that Bard’s statute of limitations defense should be disregarded because it is a bellwether action. The judge said he will issue his analysis in the next two or three weeks.
