Parties Submit Proposed Briefing Schedule for S&N’s Motion to Dismiss BHR Suits as Untimely

BALTIMORE — The parties in the Birmingham Hip Resurfacing multidistrict litigation have submitted a proposed briefing schedule for Smith & Nephew Inc.’s motion to dismiss 55 complaints as untimely.

In a July 5 submission before Judge Catherine Blake of the U.S. District Court for the District of Maryland, the parties suggested July 30 for plaintiffs’ response in opposition, and Aug. 21 for S&N’s reply. The parties also suggested that the motion be heard at the Aug. 29 status conference.
