Biomet Says Summary Judgment Appropriate on Statute of Repose Grounds in M2a Hip Cases

SOUTH BEND, Ind. — Biomet is urging an Indiana federal judge to award it summary judgment on statue of repose grounds in eight M2a Magnum hip implant cases, arguing the plaintiffs have failed to offer evidence that they suffer from a “disease” and that the manufacturer “concealed” information from them.

In a June 7 reply filed in the U.S. District Court for the Northern District of Indiana, Biomet argues that it has put forth evidence that the plaintiffs’ claims are barred by the applicable statutes of repose.
