Majority of Medtronic Insulin Pump Claims Preempted, Federal Judge Rules

WASHINGTON, D.C. - A District of Columbia federal judge has awarded Medtronic Inc. summary judgment on a majority of claims related to its allegedly defective MMT-522 insulin pump, finding they are preempted because they fail to allege a violation of state law that parallels federal regulations.

However, in the Feb. 6 opinion, Judge Ketanji B. Jackson of the U.S. District Court for the District of Columbia found that manufacturing defect claims and claims related to the Medtronic MiniMed Infusion set were not preempted and could proceed.
