Miss. High Court Affirms Dismissal of Claims Against Hologic in Novasure Injury Case




JACKSON, Miss. — A Mississippi trial court properly dismissed claims asserted against Hologic in connection with its Novasure medical device because the plaintiff failed to obtain leave of court or written consent from the adverse parties before filing her second amended complaint, the state high court has ruled.

On Dec. 17, the Mississippi Supreme Court further affirmed that the plaintiff’s first amended complaint did not relate back to the original complaint’s filing date because the plaintiff had offered no proof that Hologic had notice of the original complaint within 120 days of its filing.
